Avid  Autos, LLC (“Avid Autos”, “Avid”, “we”, “us”, “our”) is committed to providing a secure and fair online market and community for our buyers, sellers, service providers and contributors (“you”, “your”, or “yours”). To this end and to support this commitment, we reserve the right to regularly review and update the rules, policies and procedures that govern our expectations of our buyers, sellers, service providers and contributors to our site.

Please make yourself familiar with our rules, policies and procedures. Doing so will help us maintain a safe environment for everyone and this will contribute to building a solid Avid Autos community. It will also help you avoid interruptions and restrictions to Avid Autos and it will help you avoid costly legal problems that can come from violations of our rules, policies and procedures.

Our rules, policies and procedures cover a wide range of issues and take into consideration local, state, federal, provincial and international standards and legal requirements, while others are based on our experience and the input from our customers of how best to protect everyone using Avid Autos.

Below you will find information on products, goods and services that can and cannot be sold. We also describe the means by which we keep you safe, and how we'll protect you if something does unfortunately go wrong.

You can also reference our Website Terms of Use, Privacy Policy, and Payment Terms and Conditions. These lay out the most critical information around our terms of use, the information we collect from you, and how we keep that information safe.

General Rules

By participating in and being a member of Avid Autos, and by accessing and using the Avid Autos website, you acknowledge that you have read, understand, accept, and agree to abide by Avid Auto’s rules, policies and procedures.

Whether you are a buyer, seller or service provider on Avid Autos, we expect that your information and or your company’s/agency’s information is accurate, current and complete.  Additionally, we expect no attempt of deceit or diversion from factual information in the act of buying, selling or providing services on our site.

Avid Autos provides an online marketplace venue for sellers and service providers to advertise and promote items for buyers to bid on. Avid Autos is not involved in any transaction entered into through the online marketplace or community. Avid Autos is not involved in the buying, selling, exchanging or dealing of items or services in the online marketplace or community, nor will Avid Autos solicit orders on behalf of the sellers or service providers.

The automobiles, products, and services offered through the online venue are provided by the participating registrants and businesses on an "as is" basis. Avid Autos expressly disclaims and makes no representations or warranties and there are no conditions of any kind, express or implied, statutory or otherwise, with respect to the automobiles, products, and services offered through the online venue, including without limitation:

  • implied warranties of merchantability
  • fitness for a particular purpose
  • implied warranty of title and non-infringement
  • any implied warranty arising from course of dealing or usage of trade
  • any obligation, liability, right, claim or remedy in tort, whether or not arising from the negligence of Avid Autos 

Avid Autos is not the vendor of the automobiles, products or services made available on the site and assumes no responsibility for the items or services in any respect. The respective providers or sellers of each item or service are solely responsible for descriptions and the condition, estimates, authenticity, title, warranties, representations as to price, and all other matters relating to the offer and sale of the items.

Avid Autos is open to any person who has reached the age of majority in their home state or province. Employees of Avid Autos are not eligible to participate. Employees of participating businesses may use the site, but they cannot purchase items that are provided by their respective businesses.

You are prohibited from using any method, mechanism, device or software to affect the proper functioning of the online website, venue boards or forums. Avid Autos may, at its sole discretion and without notice, terminate the right of any participant in the online venue or user of the website to participate in the online marketplace or use the website.

All content on this website is the property of Avid Autos or the sellers. Avid Autos grants a limited license to each user of the website to make personal use only of the website itself. Any other use, including reproduction, modification, distribution, transmission, or display of the content on the website is strictly prohibited.

You agree to comply with all applicable laws, statutes and regulations regarding participation in the online marketplace, venue boards and forums. If you create a listing or try to sell a product or service that is not in compliance with Avid Autos Rules, Policies or Procedures, your listing may be removed, and you may be subject to a range of other actions, including restrictions of your buying and selling privileges and suspension of your account.

Buyer Rules, Policies and Procedures

Our Buyer Practices Policies lay out the behavior we expect from all buyers to ensure sellers and service providers are treated respectfully and can build confidence in our Avid Autos community. We want all Avid Autos members to be able to buy and sell with confidence. We want our sellers to bring great products, services and value to you, and we strive to protect them from unjust, unfair and fraudulent buyer activity. When buyers fail to meet these standards, we encourage sellers to report their concerns.

We ask that buyers pay for their items on time, abide by our rules, policies and procedures and not abuse our feedback system. The information below outlines our expectations for buyer behavior.

Violations of this policy may result in but are not limited to a range of actions, including account suspension, feedback removal, cancellation of return requests, restrictions on account privileges, and restrictions on overall buying activity.

Acceptable Buyer Practices:

  • Clear and Transparent Communications: Your communications with sellers-via email or community discussion boards should comply with our member-to-member communication policy
  • Current Contact Information: All Avid Autos members must keep their account information current. False or missing contact information is not permitted. A seller must be able to contact a buyer via their email address or the community discussion boards

Unacceptable Buyer Practices:

  • Purchase Retractions: We may take action against a buyer if we see a pattern of excessive or invalid bid retractions.
  • Malicious Buying: We consider bidding on or buying an item when you have no intention of completing the transaction, or circumventing a seller's buyer requirements, to be unwelcome and malicious
  • Fraudulent Payments: You must pay for your items using one of our accepted payment methods. We encourage sellers to make sure that payment has cleared before sending an item, and to report attempted fraud to us and to the appropriate authorities
  • Sales Receipt or Customs Declarations Fraud: Asking a seller to falsely state the final sale amount an item or declare the item as a gift on a customs form is considered to be encouraging illegal activity

Buyer Rules and Policies

When you are a buyer on Avid Autos, you are selecting the “Buy Now” button in a listing and are thus officially trying to buy an item(s). By selecting the “Buy Now” button in a listing, you are agreeing to the rules of the Avid Autos community.

Avid Autos reserves the right, at its sole discretion and without notice, to modify, extend, or terminate any online listing for any unforeseen issues or technical difficulties that vary, change or adjust the proper functioning of the listing.

Purchases can be made online 24 hours per day on the Avid Autos website.

The Seller will establish a price for each item.

Avid Autos is not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind including, but not limited to, malfunctioning of any network, Wi-Fi system, hardware or software, which may limit a buyer’s ability to participate in the listing. Avid Autos is not responsible for any online, long distance telephone, or other charges you may incur in connection with participating in the online marketplace.

 

Payment Rules and Policies

At listing close, the Avid Autos software will contact both buyer and seller by email to notify him/her that a purchase has been made. As the buyer, you may not retract your purchase and are obligated to make full payment of the total listing price.

The buyer shall pay the total purchase price directly to the seller. Specific payment instructions for each purchase are described by the seller in the listing.

It is the seller's and the buyer's responsibility to obtain any applicable or necessary licenses, registrations, certifications or any other form of approval for the items sold and to pay any fees associated therewith.

Once full payment of the total purchase price has been made on the item, the buyer will receive notice of payment from the seller. All delivery or pick-up arrangements must be made between the buyer and seller. Delivery may incur additional charges above and beyond the total purchase price, to be negotiated separately between the buyer and seller.

If the buyer fails to comply with these rules, including the obligation to make full payment of the total purchase price within the time limits and terms set out herein, in addition to other remedies available to the seller, the buyer not only will remain obligated for their final purchase amount, they will also be responsible and obligated to pay any additional recovery costs or legal fees incurred to enforce payment of these amounts. The seller may also cancel the sale and re-offer the item or sell it privately and hold the buyer liable for any costs or losses associated therewith.

It is the seller's and the buyer's responsibility to ensure that all taxes that apply to the items or transactions are collected, reported and remitted to the appropriate tax authority.

As stated in these rules, all sales are final. However, in the event that you have a problem with a member of Avid Autos, please refer to the Dispute Resolution Procedure below.

Not paying for items:

If you've clicked the Buy Now tab in a listing, you've committed to purchasing that item. If you don't pay for an item, even if you've changed your mind, you're violating our policy, which may result in account restriction or suspension as stated above. 

Changing or making additional or unreasonable demands:

When you purchase or buy an item, you have actively accepted the seller's terms as set out in the listing, as long as the listing complies with our listing policies. You can expect that the seller will do what they described in the listing with regards to shipping, payments, and item returns. We do understand that exceptional circumstances can happen, and we allow you to make reasonable and limited requests of the seller. However, we do not expect or require sellers to fulfill requests that are outside of their terms, nor do not allow unreasonable or excessive demands.

Acceptable Buyer Practices:

  • Asking the seller if it would be okay if your payment is briefly delayed due to exceptional circumstances
  • Asking the seller to use an alternative shipping option from the one specified in the listing
  • Asking to use a more expensive shipping option to get the item more quickly, and offering to pay the extra shipping cost   
  • Asking to return an item as long as it complies with the seller's return policy
  • Requesting that a seller combine shipping for multiple purchases

Unacceptable Buyer Practices:

  • Asking the seller to complete the transaction off Avid Autos
  • Demanding more time to make a payment(s)
  • Demanding a different payment method that differs from the type specified in the listing
  • Demanding a change to the shipping method or delivery location, other than those specified in the listing   
  • Demanding a discount or refund not covered in the listing
  • Demanding a Money Back Guarantee not covered in the listing
  • Threatening negative feedback or a low seller rating
  • Threatening or starting legal action without exhausting reasonable solutions     
  • Demanding additional items or services that are not included in the listing

Feedback Policies

Feedback on Avid Autos is designed to help create a strong, robust and enthusiastic community. Feedback is a means and an essential tool for letting other members know about your experience with a seller. Therefore, we strongly encourage you to be honest.

Our feedback program is intended to highlight the strengths of buyers, service providers and sellers. It is also in place to identify users that could dilute confidence in the Avid Autos community. Having stated this, we do have expectations, guidelines and policies to ensure it is used constructively and fairly.

We consider the threat of leaving inaccurate, inappropriate or negative feedback, or a low seller rating as unconstructive and we do not permit it.  We also consider threatening to do this to be feedback extortion and it is something taken very seriously within our entire community. If you allude to or make any unwarranted threat, this is considered as not being in compliance with Avid Autos Rules, Policies or Guidelines, and you may be subject to a range of actions including but not limited to restriction or suspension of your account and membership. However, if negative feedback is unfortunately deserved there is an appropriate way of proceeding.

Acceptable Buyer Practices:

  • Leaving negative or neutral feedback with an appropriate comment reflecting your experience
  • Leaving a low seller rating if the seller's performance did not live up to your expectations

Unacceptable Buyer Practices:

  • Leaving inappropriate feedback comments, or comments that contain obscene language
  • Leaving negative or even neutral feedback or low seller ratings because a seller did not provide additional goods and services not mentioned in the listing
  • Leaving negative or even neutral feedback because a seller would not agree to a Money Back Guarantee not in the listing
  • Leaving negative or even neutral feedback because a seller refused to agree to reduce or extend payments
  • Leaving low seller ratings or negative feedback for sellers that are competitors who sell the same or similar items as you. This is an example of feedback manipulation which support actionable recourse by the seller

False/Fake Reporting

We unconditionally disapprove of and completely do not permit members to abuse in any manner or make false/fake reports of any policy at Avid Autos. This type of behavior is tantamount to member extortion and is entirely illegal. Reports of policy violations to Avid Autos must be truthful and submitted with the sole intent of addressing a known or suspected violation of Avid Autos policy. All reports need to denote and factually indicate a genuine violation of an Avid Autos policy. If any member is intentionally making false/fake reports of policy violations, we may take a range of actions against their account, including but not limited to:

  • Listing cancellation(s)
  • Limits on account and membership privileges
  • Complete account and membership suspension
  • Removal of current and accumulated feedback history
  • Legal action by negatively affected member, company or corporation
  • Financial reimbursement to negatively affected member, company or corporation

Return Policies

We strongly encourage all sellers to clearly specify return policies in their listings. We also strongly encourage buyers to check the return policy specified in a listing before purchasing an item.

If you want to return an item, review the seller's return policy before initiating a return. Sellers may specify requirements for returns such as time limits, restocking fees, and who pays for return shipping.

Misusing or Abusing Return Policies

Acceptable Buyer Practices:

  • Returning a faulty item or an item that wasn't as described in the listing
  • Returning an item within the terms of the seller's return policy

Unacceptable Buyer Practices:

  • Returning an item other than or different from the item the seller shipped (e.g. a used or older model year part of the same product)
  • Claiming an item is not as described in the listing to circumvent a seller's return policy
  • Not returning the item in the condition that it was sent to you (e.g. returning a product without the accessories, hardware, attachments, cables other mechanisms that assist in its correct functioning ability)
  • Returning an item that has been damaged, altered or scratched after being delivered               
  • Not following the terms of the seller's return policy

Multiple Accounts Policy

Users may have multiple accounts on Avid Autos only if they have valid business reasons. We understand and appreciate that some of our members may choose to have different accounts for their buying and selling activities, or they may want to promote new products or a new division within their company.

Should you choose to have one account or more, we expect our members to manage each of their accounts effectively and in line with our policies, standards and best practices for all members of the Avid Autos community. It is each member’s responsibility to abide by our policies. If you do not, you may be subject to a range of actions, including limits of your buying and selling privileges and suspension of your account. Ultimately it is our goal to maintain a safe and trusted community for all our members and contributors.

Members cannot register for new accounts to avoid restrictions, consequences due to policy violations or to avoid or hide from poor account feedback. Additionally, if a member has greater than one account and one is suspended for any reason, their other account(s) may also be subject to limitations, restriction or termination.

Age Limits Policy

In order to help protect both our community, as well as underage users, we require all members to be the age of majority or older. We have this policy simply because when a member is involved in a transaction on Avid Autos they are entering into a binding contract and they must have reached the age of majority to enter a contract.

Underage User Policy

In order to be an individual or sole account holder on Avid Autos, you must be at least the age of majority or older. A person under 18 can use an adult's account only with the permission of the account holder. However, the account holder who granted permission to the person under 18 is responsible for everything done with that account.

Make sure you follow these guidelines. Should you not, you may be subject to a range of actions, including limits of your buying and selling privileges and suspension of your account.

Username Policy

Another policy linked to your user account is our Username Policy. Your username is created when you register, and it should be a name unique to you that is used to identify yourself on Avid Autos and to our community. Please see our policy below for details.

When you register your account, it is important that you choose a username that you like, and that you'll find easy to remember. Choose wisely as your username can become a valuable asset for you here on Avid Autos. We want all of our members to use a username they like and are proud of, but we don't allow members to choose a username that might violate a copyright or trademark, or a name that could misinform, deceive or confuse other members.

We do not permit usernames that include the word “Avid”, profane, lewd, explicit or obscene language. Your username cannot contain your email, web addresses URL or copyright, trademarked, brand or registered names (not owned by you or one where you have not been given permission to use). 

Acceptable Username Elements:

  • You can use usernames that include letters, numbers, and some symbols
  • Usernames have to be at least six characters long
  • You can use elements of an email address or website address (URL) that identifies you, your company or your brand. For example, if your website is www.MountainMotors.com, your username can be MountainMotors

Unacceptable Username Elements:

  • As stated above, you cannot use profane, lewd, explicit or obscene language
  • You cannot use spaces, tabs or the following symbols: @, &, ', (, ), <, or >
  • You also cannot include elements that imply an email address or website address including but not limited to .com, .net, .org, .edu or any variation of such (for example, _com or -com). For example, you cannot use MountainMotors.com or _com or -com.
  • You cannot use consecutive underscores ___
  • You cannot use an underscore _, hyphen -, or period . at the beginning of a username (for example, -mountainmotors).
  • You cannot us the same username or a similar username as another seller
  • You cannot use a term that is similar to, or might be confused with, a registered manufacturers name, registered model name or any another companies name, registration, trademark or brand (for example, F150Seller, or TotallyToyota).

You must follow these guidelines. If you don't, you may be subject to a range of actions, including limits of your buying and selling privileges and suspension of your account.       

Misrepresentation of Identity Policy

All members of the Avid Autos community are required to accurately represent their identity while on the Avid Autos website or while communicating to ask questions or complete a transaction that is/was generated on or related to Avid Autos.

We do not permit members to misrepresent themselves in any way shape or form. This includes but is not limited to misrepresenting themselves as another Avid Autos member, service provider or employee.

Violations of this policy may result in a range of actions, including but not limited to:

  • Listing cancellation
  • Limits and restrictions on account privileges
  • Account suspension or termination
  • Legal action

False, Missing or Incomplete Contact Information Policy

We require all Avid Autos members to provide up-to-date and accurate contact information. All Avid Autos members are required to provide accurate contact information such as their name, address, email address and telephone number when registering. Falsifying or omitting information is not permitted. In order to have stability in our community and continuity throughout the auction and sales processes, it is important that all members can easily communicate with each other.

It is the members responsibility to update their personal information and to keep their information active (e.g. emails, phone, fax and website) as long as they remain a member of the community. You can access your personal information by going to your account page.

Make sure you follow these guidelines. If you don't, you may be subject to a range of actions, including restrictions of your buying and selling privileges and suspension of your account.

Invalid and Inactive E-mail Address Policy

All Avid Autos member’s must always have a valid and active e-mail account. An active e-mail address is necessary so members can be contacted by other members and by us.

If a spam filter prevents e-mail messages from Avid Autos or our members from reaching an account, the account is considered to have an invalid email address and is not in compliance with this policy. Members must take steps to ensure their account is valid and working.

Non-compliance or violations of this policy may result in a range of actions, including but not limited to the cancellation of all current listings, limits on access to the website and to your account, account termination or suspension.

Your success and the success and satisfaction of all members in the Avid Autos community depends upon clear communication. Your valid and correctly functioning email address is a crucial component to clear communications.

 

Sellers and Service Providers Rules, Policies and Procedures

At Avid Autos we strive to ensure a fair and trustworthy buyer and seller experience. It is an expectation that all Sellers and Service Providers adhere to the code of conduct policies outlined below. Violation of the policies may result in the loss of your selling privileges and removal from the Avid Autos Community.

Seller and Service Provider Code of Conduct

  • Adhere to and abide by all applicable laws, codes and regulations
  • Adhere to and abide by all Avid Autos rules, policies and procedures
  • Provide and maintain current and active account information
  • At no time and by no means can you misrepresent yourself, your company, your agency or your product or services
  • At no time and by no means will you list products that may cause harm to any member or consumer of Avid Autos
  • Under no circumstance will you engage in any misleading, inappropriate or offensive behaviors including but not limited to:
    • Information provided on or about your account, your listings, and your products or services
    • Information, language or images provided in your listings
    • Communication and correspondence between you and Avid Autos, our community and your customers
  • All members are expected to behave and perform professionally and honestly at all times. Examples of non-professional and dishonest behavior includes but is not limited to the following:
    • Behavior that could be deemed as manipulative or deceitful during any part of the listing or selling process
    • Behavior that could be deemed as manipulative or deceitful during any part of the customer reviews process (including but not limited to directly or indirectly contributing false, misleading or inauthentic reviews)
    • Behavior and actions that attempt to manipulate Avid Auto’s search results or feedback ratings
    • Behavior and actions that intentionally damage a competitor or other seller, their listings or their ratings

The following information and/or images are not allowed throughout your listing

  • Phone numbers, addresses, e-mail addresses, or website URL’s
  • Pornographic, obscene, or offensive content or language of any kind or description
  • Links to other websites for placing orders, or alternative shipping offers
  • Reviews, assessments, or testimonials
  • Requests or appeals for positive customer reviews
  • Advertising or additional promotional material of additional or associated products or offers
  • Imprints, emblems or watermarks on images, photos, or videos
  • Information or data intended to create a false perceived value or sense of urgency to perform

The following information or images are not allowed throughout your Services listing

  • Pornographic, obscene, or offensive content or language of any kind or description
  • Links to other websites for placing orders, or alternative shipping offers
  • Reviews, assessments, or testimonials
  • Requests or appeals for positive customer reviews
  • Advertising or additional promotional material of additional or associated products or offers
  • Imprints, emblems or watermarks on images, photos, or videos
  • Information or data intended to create a false perceived value or sense of urgency to perform

Prohibited Seller and Service Provider Activities and Actions

These prohibited seller and service provider activities and actions are established to maintain a community environment that is safe, fair and reasonable for buyers and for sellers of both products and services. Failure to comply with the terms of this policy can result in the immediate cancellation of listings, suspension from full access to the Avid Autos site, and the exclusion of selling and listing privileges.

This policy is in addition to, and in no way limits, your other obligations pursuant to your acceptance and agreement to abide by the sites Terms of Use, Privacy Policy and other Avid Autos Terms and Conditions.

General Guidelines 

Attempts to Divert Transactions or Buyers

Any attempt to circumvent, avoid, or by-pass Avid Autos established sales process, rules or policies, or to divert Avid Autos users to another website or sales process is prohibited. Including but not limited to advertisements, marketing messages, special offers, additional or associated offers, or "calls to action" that direct, provoke, or encourage Avid Autos users to leave the Avid Autos website are prohibited. This might include but it is not limited to the following: the use of emails, hyperlinks, URLs, web addresses, or an email suffix such as .com, .net, .org, .biz and so on within any seller-generated confirmation email messages, listing or product/listing description fields.

Unauthorized and Improper Business Name(s)

Your business name (as used on Avid Autos) must be the name that accurately identifies you, your company or corporation is not misleading.

Your business name is the name that you legally possess the right to use (that is, the name cannot include the trademark of, or otherwise infringe on, any trademark, registration or other intellectual property right of any person, company or corporation).

You cannot use a business name that contains an email suffix such as .com, .net, .biz, and so on.

Inappropriate Electronic Communications

Unsolicited written, phone, or electronic communications of any kind to Avid Autos members or customers (other than as necessary for listing or sale fulfillment and or related customer service) related to sales or marketing communications of any kind are prohibited.

Appropriate Treatment of Customer Personally Identified Information (PII) Phone Numbers, Location (e.g. geographical address) and any and all Electronic Identification (e.g. electronic address)

Avid Autos provides access to customer PII, phone numbers and other electronic identification to sellers and service providers, so they can fulfill their orders. If you receive this form of customer information, you are required, and it is your responsibility to adhere to Avid Autos Privacy Policy. Proper treatment of Personally Identifiable Information (PII):

    • Only print on labels or shipping documentation to comply with carrier requirements
    • Dispose of any customer data after you have processed the customer's orders
    • Manage personnel in your organization that have access to customer personal information, protecting of this data is your responsibility

Inappropriate Treatment of Customer Personal Information

  • Do not contact a customer using their phone number. To contact a customer about their order, you must only use the clients preferred electronic communications tool. This policy is in place to protect buyers, sellers and service providers.  
  • Never share any customer personal information with an external party
  • Never forward customer information of any kind without the sole written or electronically recorded approval of the customer

Misrepresentation of Identity

We do not permit members to misrepresent themselves in any way shape or form. This includes but is not limited to misrepresenting themselves as another Avid Autos member, service provider or employee.

Violations of this policy may result in a range of actions, including but not limited to:

  •  Listing cancellation
  •  Limits and restrictions on account privileges
  •  Account suspension or termination
  •  Legal action

Misuse of Ratings, Feedback, or Reviews

  • Any attempt to manipulate ratings, feedback, or reviews is prohibited
  • You cannot post inaccurate, abusive or inappropriate feedback
  • You cannot include personal information, company information or transaction partner information
  • You cannot post ratings or feedback to your own account
  • You cannot pay or offer any incentive to a buyer for either providing or removing feedback

Note regarding Avid Autos ratings, feedback and reviews: The rating, feedback and reviews  features generated within the Avid Autos website is created to allow members and visitors of Avid Autos to evaluate the overall performance of buyers, sellers and service providers. This process cultivates and fosters their reputation within the Avid Autos Community. It is a forum for positive or negative feedback about product and service details and reviewer's experiences.

Misuse or Manipulation of Search and Browse Function

When customers use the Avid Autos search engine and browse function, they deserve to see relevant and accurate results and information. Any attempt to manipulate the Search and Browse Function is prohibited. Prohibited behaviors include, but are not limited to:

  • Artificially simulating the amount and frequency of customer traffic
  • Providing misleading, inaccurate or irrelevant product, inventory, or listing information

Illegally Manufacturing, Creating or Rendering Products, Over Selling/Promising Your Ability to Personalize and Customize Automotive Products or Services

Note regarding custom or customized products or services: Buyers frequently shop for custom or customizable automotive products on Avid Autos. They expect these products or services to be personalized, customized, or configured to the personal choices entered during the purchase process.

Prohibited behaviors include, but are not limited to:

  • Any attempt to manipulate functionality of a product in a manner which circumvents existing local, state or federal laws is not permitted.
  • Customizing products to circumvent existing category guidelines or policies
  • Advertising or offering free gifts or promotions as a substitute for actual product customization
  • Customization or personalization of products cannot restrict other seller listings

Additional Guidelines for Sellers of Automobiles and Automotive Products  

Any attempt to increase the sales price of an automobile or product after completion of a Buy Now purchase is prohibited.

  • Post-transaction price gouging or manipulation via fees or services is not allowed
  • Sellers cannot set excessive order fulfillment, restocking fees and shipping costs
  • Listings and product offerings must accurately describe the actual product for sale (the product being offered must be listed in a manner that accurately describes the product in all respects)
  • Sellers cannot create separate or duplicate listings for identical copies of the same product listing

Additional Guidelines for Service Providers

Any attempt to upsell or increase the sales price of a service after the close of a sale or selling transaction is prohibited. The service provider must perform the service as outlined in the scope of work on the service detail page on the date the service was purchased. The service provider may not solicit additional products, parts, or service orders before, during, or after the service call.

If the buyer requests services, parts, or products outside of the defined scope of work, then the service provider might fulfill that request and charge the buyer directly.

One last comment:

We work hard to make shopping on Avid Autos safe and fun. We hold Sellers and Service Providers on Avid Autos to a high standard of customer service. Our Rules, Policies and Procedures defines our expectations of Sellers and Service Providers. We hold Sellers and Service Providers accountable to these performance standards when buyers report a problem with a purchase.

While most buyers follow the rules, we also need to protect sellers from unsafe and unfair behavior, and from buyers who try to take advantage of our protection systems. This is why we also have rules and policies for our Buyers.

 

Prohibited and or Restricted Items Policy

It is an important responsibility to maintain the safety of our community. It is a responsibility we take very seriously. For this reason, and to comply with local, provincial, state, federal, provincial and international laws, regulations, codes and restrictions, some categories of products and services are limited, or are completely prohibited from being listed.

If you are unsure if an item or service you are intending to list is allowed or not, search the applicable categories from the list below to find out. This list serves as an example of potential prohibited and or restricted items, it is not a finite or complete list. All products or services listed for sale on Avid Autos must meet any and all local, state, federal, provincial and international laws, regulations, codes and restrictions.

Alert: It is the sole responsibility of the seller or seller’s agent/employee to verify prior to listing said product or service that any and all products or services are approved by any and all law(s), regulation(s), code(s) or restriction(s).

 

Stolen Vehicles and Stolen Property Policy

Listing or selling stolen vehicles or stolen property (including Intellectual Property) of any kind is against the law. It violates local, state, federal, provincial and international law. We gladly notify law enforcement of any attempts to sell stolen property on our site, and we will assist in the investigation and prosecution of sellers who violate this policy.

Recalled Items Policy

Due to the obvious potential safety issues, we do not allow the listing of items that are banned, recalled, or could in any way be hazardous to any member of our community. Sellers are not allowed to list items that are prohibited from being sold due to a recall.

If an item can be legally sold but is subject to a recall, it is the seller’s responsibility to clearly include appropriate information about the recall within the listing. Any and all items sold must follow all applicable local, state, provincial, federal laws and international laws and regulations, including the U.S. Consumer Product Safety Improvement Act. We strongly support all governmental agencies, including the US Consumer Product Safety Commission (CPSC) in their efforts to protect consumers against potentially hazardous products.

Before you list an item, check the manufacturer's website, the US recall information website, and the OECD Global Recalls portal to access information on recalled items.

What is Allowed and Permitted

  • Products that are currently subject to a recall, but the sale of the product is not prohibited by law or regulation, as long as the listing includes the recall information
  • Child safety seats must comply with all Federal Motor Vehicle Safety Standards
  • You must indicate in your listing the car seat meets these standards

What is Not Allowed or Permitted

  • All recalled air bags are prohibited for sale
  • Products recalled by the CPSC or NHTSA
  • Products recalled by a manufacturer or another government agency if the sale of the product is prohibited by law or regulation

Electrical and Electronic Equipment Policy

Certain electronic equipment, such as equipment prohibited by the Federal Communications Commission (FCC), cannot be listed or sold on Avid Autos. To comply with the FCC and other legal requirements and regulations, and to protect your rights and our community’s privacy and safety, we have created and enforce restrictions around the sale of electrical and electronic equipment. Some examples include, cell, radar, laser, GPS and other signal jamming devices are not allowed. We also do not permit the listing of, or sale of electronic products or electronic equipment that encourage the use of visual/photographic or auditory devices used to secretly record the personal conversations or activities of others without their approval and knowledge.

What is Allowed and Permitted

  • Low-power radio transmitting devices and related products and equipment: The FCC limits and restricts how powerful these items can be. FM transmitters are limited to a range of approximately 35-100 feet. AM transmitters are limited to a range of approximately 200-250 feet. Sellers cannot list devices that claim or suggest they have a greater range
  • High frequency transceivers: Equipment that is intended to operate in various radio services in the high frequency radio spectrum, including "10-meter" Amateur Radio Service (ARS) equipment, can be listed. However, sellers cannot list high frequency transceivers that are designed to operate on frequencies outside of the ARS bands
  • Radar and Laser detectors: Radar and Laser detectors can be listed as long as they are authorized by the FCC

What is Not Allowed or Permitted

  • Odometer modification devices
  • Cell, radar, laser, GPS, and other jamming devices: Signal jamming devices that claim to block, jam, or otherwise interfere with radio frequency communication signals or police radar are not allowed. This includes devices that jam or block cell phones, radar detectors, GPS, Wi-Fi, or any other authorized communications signal
  • Traffic light or traffic signal control devices, signal changers or descramblers: Products that claim to change stoplights or otherwise inhibit the natural pattern of a traffic signal are not allowed
  • CB radios and amplifiers that do not meet FCC requirements are not allowed

Digitally Delivered Goods Policy (often referred to as Intellectual Property)

We consider digitally delivered goods to be information or content that can be electronically transferred or downloaded from a website or be received electronically via a wide variety of means. You can list digitally delivered goods on Avid Autos just as long as you follow the guidelines below.

What is Allowed or Permitted

  • Your listing clearly states that you legally own the content, or you are legally authorized to sell it by the owner or by the owner's authorized agent

What is not Allowed or Permitted

  • Your items must not have any sexually-oriented adult (pornographic) content
  • Your item cannot include software that would damage anyone's computer, could be used for malicious purposes (e.g. sending spam emails or spreading a computer virus) or would violate anyone's privacy (e.g. spyware or cookies)

Please make sure you follow these guidelines. If you do not, you may be subject to a range of actions. We reserve the right to limit, restrict, or suspend you from buying, selling, or using site features. All of your listings may be removed, displayed lower or not shown in search results, without refunding any or all applicable fees.

The following products, goods and items can be offered digitally.

  • Any digital product you wrote, recorded, and own all the rights to

What is Not Allowed or Permitted

  • Digital information or images copied from the internet, from a DVD or CD you own or burned
  • eBooks you do not own the copyright to and are not legally authorized to resell by the owner, the owner's authorized agent
  • Digital information or images you purchased from an outside source or vendor but are not legally allowed to resell
  • Digital files of product manuals, instruction manuals or user guides that you do not own the copyright of or you aren't legally authorized to resell by the owner or the owner's authorized agent

Emission and Exhaust Products and Devices Policy

Avid Auto does allow the sale of catalytic converters except for those that are prohibited by the U.S. government, the EPA (Environmental Protection Agency) and individual states that have established specifications and prohibitions. We do not allow items to be sold or listed that are designed to defeat, bypass, or shut down catalytic converters, oxygen sensors, and malfunction indicator lights.

You must make sure your listing follows these guidelines. If it does not, your listing may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account.

Catalytic Converters Policy

What is Allowed or Permitted

New Catalytic Converters as stated earlier are allowed.

  • New catalytic converters that meet the EPA (Environmental Protection Agency) and individual state requirements for aftermarket sale are permitted
  • Used Catalytic Converters that have been recertified are permitted for sale as long as the recertification meets EPA (Environmental Protection Agency) and individual state requirements

What is Not Allowed or Permitted

  • Used catalytic converters that have not been recertified cannot be listed or be available for sale

Other Products Related to Catalytic Converters that Are Not Allowed or Permitted

  • Oxygen sensor simulators 
  • Malfunction indicator light eliminators
  • Any product that indicates it will defeat, bypass, or shut down emission control devices

Test Pipes, Exhaust Pipes and Down Pipes Policy

What is Allowed or Permitted

  • Test pipes (often called Straight Pipes) are allowed if they are marketed as race car parts or race car accessories only. Test pipes are not approved for use on street-legal vehicles, and in the listing, it must clearly be stated that they are not street legal
  • Exhaust manifolds, exhaust pipes and down pipes that are manufactured for, and are licensed for, street legal cars and trucks only, are allowed for listing
  • Auto racing parts, products, manifolds, test pipes, exhaust pipes or down pipes that are manufactured exclusively for auto racing are allowed for listing, but these parts must only be listed as an auto racing product only

What is Not Allowed or Permitted

  • Any part or product that is listed as street legal but is not manufactured or licensed as street legal, is not allowed
  • Auto racing parts, products, test pipes, exhaust pipes and down pipes that are not clearly listed as an Auto Racing Only product
  • Non-auto racing parts, products, exhaust pipes and down pipes that indicate they will defeat, bypass or not conform to EPA standards must not be listed

Automotive Art or Automobilia Policy

Avid Autos encourages the lawful sale of automotive art and automobilia on its website. Please ensure that your listing follows the guidelines described below.

The following guidelines have been created via consultation with the automotive art and automobilia community. We have taken this course of action because automotive art and automobilia pieces are our communities’ history. These guidelines do not replace or supplant Avid Autos Website Terms of Use or general seller policies but go further to enhance those policies. Sellers are encouraged to abide by these guidelines when selling automotive art and automobilia on Avid Autos:

What is Approved and Permitted

  • The sale of your own original artwork
  • The sale of artwork and automobilia that you are authorized or licensed to resell
  • The sale of reproduced automotive art or automobilia you are authorized or licensed to sell

When listing a reproduction or an exact replica art piece or automobilia product:

  • Use of the word “Original” or “OEM” can only be used if the piece is in fact original or manufactured by the original equipment manufacturer
  • Any piece that is not original or an OEM product, must be listed as a "Reproduction" or "Repro" piece and must be clearly stated as such in the listing title and product description       
  • You may include the artist's or original manufacturer’s name in the title of the listing only when listing a work by the artist him/herself or by the original manufacturer
  • If it is an exact replica of the artist's or original manufacturer’s work, it must be listed as such
  • For art pieces, you may not include the artist's name when listing a work done "in the style of" an artist or manufacturer
  • If any alterations, conservation, or repairs have been performed on the work of art or automobilia product, you must disclose this information in a clear and prominent manner within the item description
  • Knowingly selling, exhibiting, trading, producing, or advertising any unauthorized copy or reproduction of any work of art or automobilia product is not permitted
  • You may not disclaim knowledge of, or responsibility for, the authenticity of an item that you describe as and or knowingly list as genuine
  • Describing or marketing any item or product as genuine if you cannot provide reasonable evidence to prove its authenticity is not permitted
  • Knowingly participating in any way in the listing, sale or advertisement of any work of art or piece of automotive history (automobilia) using any deceptive practices, including, but not limited to, false or misleading claims of the item's scarcity, value, provenance, condition or investment potential is not permitted

What is Not Approved or Permitted

  • You may not sell any form of reproduced automotive art or automobilia (eg., poster, print, catalog, pamphlet, book, manual, brochure or exact replica art object, painting, advertising material or product replica) if it violates any applicable laws, copyrights, or trademarks
  • You must follow the rules listed above in the description of “When listing a reproduction or an exact replica art piece or automobilia product”

Autographed Products Policy

Signed or autographed products are unique, and they hold significant perceived value. However, these products are unfortunately easy to forge or reproduce. Autographs are commonly sold with certificates of authenticity (COAs) and or letters of authenticity (LOAs). COAs and LOAs, are meant to assure the buyer that the signature or product is genuine. However, COAs and LOAs, are also easy to forge and reproduce and are only as valuable as the reputation of the issuing party, so it's important to know the reputation of each authenticator or grader.

We investigate reports and concerns from our members in regard to autographs, COAs and LOAs by consulting with numerous reputable specialists and third-party professionals. These specialists and third parties may reference known authentic autograph examples to determine if these items are genuine. If they have concerns about an item’s authenticity, Avid Autos may remove the listing from the site.

Make sure your listing follows the above guidelines. If it does not, your listing may be removed, and you may be subject to a range of actions, including limits of your buying and selling privileges, suspension of your account, and financial responsibility for any costs incurred for authentication or legal actions.

Hazardous Materials, and Restricted or Regulated Products and Materials Policy

At Avid Autos we feel it is important and it is our duty to do our best to take care to protect the health and safety of our members, our community and our environment. Our hazardous material, and restricted or regulated products and materials policy reflects this commitment to your safety by strictly adhering to government regulations on the sale and transportation of dangerous goods.

For restrictions on the sale and shipping of potentially hazardous materials please refer to the shipping guidelines from the U.S. Postal Service and the U.S. Department of Transportation (DOT).

State and federal regulations prohibit shipping various hazardous products, though there are a few types that can be legally transported under certain conditions and if they're properly packaged and labeled. Those items can be sold on Avid Autos, as long as the listing clearly describes the hazardous nature of the product and it clearly specifies an approved shipping method that meets state and U.S. Postal Service (USPS) requirements.

What is Allowed and Permitted

  • Combustible items - Combustible items that the U.S. Postal Service (USPS) has identified as ORM-D (Other Regulated Materials-Domestic) have to include specific shipping restrictions in your listing. See the USPS website for mailing requirements
  • Refrigerants - In order to sell refrigerants, the law requires sellers to make sure that the buyer is certified by the Environmental Protection Agency (EPA).

What is Not Allowed or Permitted

  • Combustible materials that the U.S. Postal Service (USPS) has prohibited for shipping
  • Flares (both projectile and road flares)
  • Non-EPA approved refrigerants (see the EPA website for more information)

Key, Key Cutting, Lockpicking and Duplication Machine Policy

Avid Auto does not allow the sale of keys, key cutting, lockpicking and duplication machines. For obvious legal and security reasons we do not allow items to be sold or listed that are designed to defeat, bypass, or render useless safety and protection devices or that can be used to facilitate crime.

What is Not Allowed or Permitted

  • Key cutting machines and other devices that can be used to make duplicate keys
  • Lockpicking devices or locksmithing equipment 
  • Automotive lock bypass keys (also called jigglers), bump keys, digital decoders or code copying or stealing devices   
  • Key cutting machines - functional or not (includes automatic or hand-held manual cutting devices), code cutters and cam cutters
  • Lockpicks, lockpick tool sets, lockpick cards, lockpick gun, tubular lock picks, tension bars, or Slim-Jims
  • Master keys, skeleton keys or try-out keys  

Chance/Skill, Opportunity, Drawings or Contest Listing Policy

All giveaways, lotteries, opportunities to win, mystery items, sweepstakes, random drawings, raffles, raffle tickets and chance or skill contests are highly regulated. Therefore, we don't allow listings that sell an opportunity to win an item or prize, whether that's by chance or in a contest.

Avid Autos reserves the right to run and promote contests or giveaways either by us or under contract with our partners or third-party companies. However, seller listings that promote giveaways lotteries, sweepstakes, random drawings, raffles or contests are not permitted or allowed.

Please be sure your listings follow these guidelines. If they do not, some or all of your listings may be terminated or not displayed in search results. Additionally, you may be subject to a variety of other actions, including but not limited to limits being placed on your buying and selling privileges.

What is Allowed or Permitted

  • Bonus, extra or additional items are allowed in your listing as long as it meets our selling requirements   
  • All offers, bonuses or free gifts must include the exact same bonus item(s) to all buyers
  • All contents, number, quality, and condition of each item must be clearly identified

What is Not allowed or Permitted

  • You may not set any conditions that must be met before the bonus applies
  • Listing offers, bonuses, extra, additional items or free gifts in the listing title
  • A perceived value or collectability value of any item may not be included

Law Enforcement or Quasi-law Enforcement Related Products, Pieces or Articles Policy

To aid in preventing the impersonation of law enforcement officers or quasi-law enforcement agencies (e.g. fire or EMT - Emergency Medical Treatment personnel), we do not allow certain police, highway patrol, fire department or EMT related products, uniforms, badges, patches or other articles to be listed on Avid Autos. In general, any official local, federal, state, provincial, international and quasi-law enforcement and law enforcement agency equipment is not allowed for sale.

  • Decommissioned law enforcement and emergency vehicles that do not have current decals or prohibited lighting
  • Toy or model police car, fire truck and EMT vehicle decals (scaled to size for toys or models)  
  • Emergency light bars that offer only amber or clear lenses and LED’s

What is Not Allowed or Permitted     

  • Fully operational law enforcement or emergency vehicles with lights, sirens, etc.
  • Lighting for emergency vehicles
  • Listings for emergency lighting systems that have black and white or stock images
  • Red, green, or blue lenses and LED’s used for emergency vehicle lights
  • Siren controls or amplifiers for emergency vehicles
  • Specific law enforcement decals

Uniforms Policy

  •  Utility belts or belt accessories

What is Not Allowed or Permitted

  • Military police uniforms or components of those uniforms
  • Official, current- or recent-issue police uniforms or components of those uniforms (such as boots, hats, helmets, jackets, and shirts)
  • Official, current- or recent-issue military uniforms
  • Any Customs and Border Protection uniforms or components of those uniforms, including shoulder patches
  • Any authentic prison uniforms

Primary Ticket Sale, Event Ticket Sale and Resale Policy

Selling and reselling tickets to events like car shows and contest, races, museums, or other automotive events is allowed on Avid Autos.

Standards for professional conduct:

To promote safe selling of event tickets on Avid Autos and to make sure that sales follow all laws related to tickets sales, we've developed standards for professional conduct for selling tickets. These standards do not replace nor dismiss Avid Autos general seller rules and policies, but rather supplement those rules. Sellers must follow these guidelines when selling tickets on Avid Autos.

Standards and Guidelines:

  • The seller agrees not to list, sell, trade, produce, advertise tickets that they are not contracted or licensed to sell
  • The seller agrees not to list, sell, trade, produce, or advertise tickets that they do not have in their possession
  • The seller agrees not to participate in any way in the advertisement, sale, or trade of any ticket using any deceptive practices including, but not limited to, false or misleading claims of sales scarcity, face value, or current value
  • The seller agrees to promptly refund the purchase price for any ticket which has been deemed by the venue to be counterfeit or unacceptable for gaining entry to an event
  • The seller agrees to abide by all local, state, federal, state, and international laws relating to tickets sales

What is Allowed and Permitted

  • You can sell and resell most event tickets as long as you make sure that the transactions do not violate any laws
  • Listings for events that take place in regulated locations must follow the guidelines for that location
  • First Sale and or Primary Tickets may be sold (First Sale or Primary Tickets are tickets sold directly by the promoter, team, manufacturer, club, or organizer of the event). You must clearly and explicitly state in the listing that it is an authorized first sale of the ticket to the public and that it is being listed directly by the promoter, team, manufacturer, club, or organizer
  • Ticket packages can be listed as long as they qualify as a ticket package and that you make sure that the package does not violate any laws or regulations. To qualify as a ticket package, you have to sell a ticket with one of these combinations; at least one item or experience of significant value that relates to the ticket event that you've coordinated with the event promoter, team, manufacturer, club, or organizer. Here are some examples:

A meeting with a driver, a team, club, builder, automotive celebrity, etc.

An "experience" for example, being a driver at a race course or being a pit crew member at a race

A complete or all-inclusive travel package for the event that includes lodging, food and transportation to and from the event and lodging for the event

Tickets to charity events and free events as long as these tickets are not free to the public

 

Dispute Resolution Policy

If you have a dispute regarding a listing, a sale, or with a service provider or member of the Avid Autos Community please do your best to resolve the issue with the other member. It is our experience that a substantial majority of disputes are resolved when both parties initially attempt to clarify and resolve their issue(s).

Online or Internet business and commerce operate by the same rules and regulations as traditional businesses, with a few specific exceptions and rules that apply to the unique nature of doing business electronically. Within the United States, online, internet or electronically based companies are regulated by the U.S. Federal Trade Commission (FTC). The FTC oversees business compliance for the United States. Most of the rules and regulations specific to internet commerce revolve around issues of privacy, data collection, how customer information is used and truth in advertising.

Internet commerce of any kind cannot be false, misleading or deceptive. Claims of false or misleading advertising or business practices must be substantiated with documented proof. According to the FTC, a claim can be misleading if relevant information is left out or if the claim implies something that's not true.

Deceptive Practices are defined by the FTC in Section 5: Unfair or Deceptive Acts or Practices as:

An act or practice is deceptive where

•   a representation, omission, or practice misleads or is likely to mislead the consumer;

•   a consumer’s interpretation of the representation, omission, or practice is considered reasonable under the circumstances; and

There are professional and legal limits to how much we can assist in problem resolution:

We do not advocate or take sides to force a resolution between members

We do not mandate or dictate the content of seller policies or their terms of a sale

We do not mediate, arbitrate, or get legally involved in member disputes, problems, and/or issues

We do not take action against any member based on an unresolved dispute

Unless prohibited by law, we will assist any and all government agencies with information they request to assist in the resolution of a dispute

Please understand the limits described above. We will always strive for positive resolution outcomes, but we are not in a position to determine or judge the merits of your dispute or mandate a resolution of your particular case. The intent of our policy is to encourage our members to behave ethically and professionally. Our role in disputes is limited to facilitating the communications between parties in hopes of reaching a positive resolution.

 

Dispute Resolution Guidelines:

We request that you contact the member at least once to relay your dissatisfaction before filing a complaint with Avid Autos. We make this request to allow the member an opportunity to resolve the matter before we step in.

Complaints must be a result of a transaction made solely through Avid Autos and be less than 90 days old. We do not get involved in complaints regarding shipping, packing and restocking fees. These fees vary widely from seller to seller and are individually set, some according to the individual company policy.

We encourage both parties to contact us when unresolved conflicts arise between members. We will facilitate an exchange of information between those involved in an effort to encourage an amicable resolution.

If you cannot reach an amicable agreement or resolution to your dispute, please fill out the Dispute Resolution Form here and e-mail it to our Customer Service Department.

When we receive your Dispute Resolution Form, we will notify the other member that we have received your complaint and will request a response from the other member. It has been our experience that more than half of the problems are resolved by the members at this point.

Our role in resolving disputes between members is strictly limited to facilitating a conversation between members regarding the dispute. We do not advocate the position of any member, do not decide which party is at fault, and do not decide how disputes are to be resolved. After we receive a Dispute Resolution Form, once we put the members involved in the dispute in communication with each other, our responsibility to the members regarding the dispute ceases. If the members are not able to resolve the dispute on their own, upon written request we may provide the parties with information on alternative dispute resolution methods such as mediation.

 

Educate Yourself About Scams and listen to your gut and intuition.

VERIFY, VERIFY, VERIFY that the vehicle or parts exist prior to purchase.

Ask for documentation of ownership

Inspect a vehicle in person or send a representative

Request specific photos of the vehicle and or parts you are interested in. Request that the photos or other documentation you seek is recent date & that it includes contact information of seller

AVOID, AVOID, AVOID offers that:

The vehicle, product or item of interest is or sounds like it is too good to be true

The price is too good to be true

Someone requests personal information - such as names, addresses, passwords, credit card numbers

Receipt of an email claiming to be Avid Autos or another Avid Autos member and requesting personal information. Note: Avid Autos does not and will never ask a member to send us (Avid Autos) sensitive information through email. If and or when Avid Autos does request sensitive information, we (Avid Autos) will always direct its members to the Avid Autos website. Avid Autos members can submit the requested information through their "My Account" page.

The buyer or seller is creating or conveying a sense of urgency in their communication, or they are trying to force you to expedite the transaction

There is a request to involve or bring a 3rd party into the transaction

There is a request that would involve you facilitating money transfers through your account   

A buyer sends you a cashiers check for more than the agreed amount

A seller instructs the buyer to wire, credit or mail a deposit to hold the vehicle or product

Note: please remember, cashier’s checks are not cash. Just because the bank deposits a cashier’s check and makes the money available to you does not mean it is a guaranteed check. Many scammers will ask you to deposit a bad or phony cashiers check and then wire them back a portion of those funds. By the time the bank realizes the check was fake or counterfeit you are still responsible for that money.

 

SECURE, SECURE, SECURE money and any fund transfers by using an escrow service. Escrow is the safest way to transfer funds because your funds are held by the bank assuring both buyer & seller, they are secure. Funds are not released until buyer receives, inspects and approves merchandise.

 

NEVER, NEVER, NEVER disclose your bank account, credit card or social security information to sellers, unsolicited callers or emails. Scammers are dishonest unprincipled and deceitful. Essentially, they are thieves who manipulate and steal money from innocent individuals. Do not give them any information about yourself.

PROTECT, PROTECT, PROTECT your personal information. Double check websites before entering your user names and passwords, especially if an email prompts you to do so. Check your financial accounts and statements regularly for unauthorized activity, monitor your credit report, and shred any and all documents that contain your personal information such as bank & credit card statements, etc. Scammers will often request account information such as your account number or the banks routing numbers in order to wire funds. Do not provide any information without first checking with your bank or financial institution.

Protecting yourself from the most common scams on the internet takes awareness and common sense. A lot of personal information as well as money changes hands on the internet and in the automotive and collector car community, this makes us all susceptible to dishonest and unprincipled people. The key is to stay alert and learn to spot the warning signs.

Unfortunately, there is no guaranteed way to prevent these criminals from using the internet or Avid Autos. We work hard to identify and catch these unscrupulous people and we have high quality and up to date filtering software, but nothing is failsafe or foolproof. Scammers can target any website or online business or marketplace. Once again, please use your common sense and intuition before you proceed with any person or transaction. Always proceed with extreme caution when responding to any offers or requests from questionable sources.

10 Things You Can Do to Avoid Fraud

Criminals use clever schemes to defraud millions of people every year. They often combine new technology with old tricks to get people to send money or give out personal information. Here are some practical tips to help you stay a step ahead.

  1. Spot imposters. Scammers often pretend to be someone you trust, like a government official, a family member, a charity, or a company you do business with. Don’t send money or give out personal information in response to an unexpected request — whether it comes as a text, a phone call, or an email. 
  2. Do online searches. Type a company or product name into your favorite search engine with words like “review,” “complaint” or “scam.” Or search for a phrase that describes your situation, like “IRS call.” You can even search for phone numbers to see if other people have reported them as scams.
  3. Don’t believe your caller ID. Technology makes it easy for scammers to fake caller ID information, so the name and number you see aren’t always real. If someone calls asking for money or personal information, hang up. If you think the caller might be telling the truth, call back to a number you know is genuine.
  4. Don’t pay upfront for a promise. Someone might ask you to pay in advance for things like debt relief, credit and loan offers, mortgage assistance, or a job. They might even say you’ve won a prize, but first you have to pay taxes or fees. If you do, they will probably take the money and disappear.
  5. Consider how you pay. Credit cards have significant fraud protection built in, but some payment methods don’t. Wiring money through services like Western Union or MoneyGram is risky because it’s nearly impossible to get your money back. That’s also true for reloadable cards (like MoneyPak or Reloadit) and gift cards (like iTunes or Google Play). Government offices and honest companies won’t require you to use these payment methods.
  6. Talk to someone. Before you give up your money or personal information, talk to someone you trust. Con artists want you to make decisions in a hurry. They might even threaten you. Slow down, check out the story, do an online search, consult an expert — or just tell a friend.
  7. Hang up on robocalls. If you answer the phone and hear a recorded sales pitch, hang up and report it to the FTC. These calls are illegal, and often the products are bogus. Don’t press 1 to speak to a person or to be taken off the list. That could lead to more calls.
  8. Be skeptical about free trial offers. Some companies use free trials to sign you up for products and bill you every month until you cancel. Before you agree to a free trial, research the company and read the cancellation policy. And always review your monthly statements for charges you don’t recognize.
  9. Don’t deposit a check and wire money back. By law, banks must make funds from deposited checks available within days but uncovering a fake check can take weeks. If a check you deposit turns out to be a fake, you’re responsible for repaying the bank.
  10. Sign up for free scam alerts from the FTC at ftc.gov/scams. Get the latest tips and advice about scams sent right to your inbox.

If you spot a scam, report it at ftc.gov/complaint. Your reports help the FTC and other law enforcement investigate scams and bring crooks to justice.
